Warranty

 

Our Product(s) come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the Product(s) fail to be of acceptable quality and the failure does not amount to a major failure.

SilverCross reserves the right to stop manufacturing a particular model, colour, fabric or accessory; in this instance we will replace with a similar part, colour or fabric during the manufacturer’s warranty period.

SilverCross provides this Warranty set out in this clause for its Product(s) that have been purchased in Australia. This Warranty is subject to the Australian Consumer Law. The benefits provided in this Warranty are in addition to other rights and remedies of a consumer under the Australian Consumer Law, and any other laws in relation to the Product(s)to which this Warranty relates.

The Warranty is applicable to your SilverCross Product(s), sold through the Website or through any official SilverCross physical locations. Customers should read and consider the user guides carefully before assembling and using any SilverCross Product(s).

The Products are covered against faults in material and workmanship when used under normal conditions, according to user manuals and technical specifications, for a period of 24 months once registered online from the date of dispatch of the product from SilverCross to the customer. The 24 Month Warranty includes all manufacturing defects relating to:

Prams: 
I. Chassis, frame, wheels and adapters;
II. 5-point harness buckle, padding, strapping and assembly; and
III. All soft good seams, bindings and zippers.

Accessories: 
I. All soft good seams, bindings and zippers.

Subject to clause 7.1.1 and 7.1.2, if a Customer discovers a fault in a Product’s material or workmanship, and SilverCross inspect the Product and confirms that it is a fault, then SilverCross will replace the Product or faulty part of the Product, or repair the fault if notified within the 24 Month Warranty period.

7.1.1 If there is a major failure with a Product(s), the Customer is entitled to:
(i) reject the Product(s) and get a refund;
(ii) reject the Product(s) and get a replacement, or one similar in value if reasonably available; or
(iii) obtain compensation for the drop in value of the Product(s) as determined by SilverCross in its sole and absolute discretion.


If there is a minor failure with the Product(s), the Customer is entitled:
(i) have the Product(s) repaired or replaced; or
(ii) a refund of the cost of the Product(s).

7.1.2 To lodge a Warranty claim, the customer is required to take the pram back to the place of purchase  website, and submit the form to our Customer Care team. A member of our team will contact the customer reach out to you within seven (7) business days to discuss the claim and next steps.

7.1.3 Customers are liable for any transportation costs if the Product(s)is not found to be faulty.

7.1.4 Customers are liable for any transportation costs if they require replacement or warranty parts to be shipped internationally, even if Product(s) are within the Warranty claim period. 

7.1.5 To the extent permitted by law, the following are not covered by Warranty:

  • failure or defects resulting from improper care or use;
  • normal wear and tear including scratches to the pram frame;
  • scuffs and tears to leatherette handles/bumpers (prams);
  • products purchased second hand or from an unauthorized distributor;
  • fading or discoloration of fabrics and materials due to cleaning and/or excessive sun exposure;
  • stains, discoloration or damage to leatherette, caused by the use of cleaning or sanitiser products containing alcohol;
  • faulty or incorrect assembly of the products by the customer;
  • installation of a part or accessory not compatible with the product and/or not manufactured by SilverCross
  • any modification or alteration not conducted or authorized by SilverCross
  • corrosion or rust on the wheels and chassis due to extreme environmental conditions, including high humidity, salt spray, ice or snow or due to insufficient maintenance (prams);
  • accidental or intentional damage, abuse or neglect;
  • damage to handle bar grips or fabrics as a result of normal handling and daily use (prams);
  • airline/transport damage: check your SilverCross product carefully after it has been handled by the airline (or other transporters) and if required, submit your claim directly to your travel insurer/ airline;
  • consumer dissatisfaction with the product in terms of disliking the fit, weight, functionality, colour or style (outside of the 30 Day Trial period);
  • if the serial number has been damaged or removed; and
  • when the product has not been used for normal use and in accordance with the manufacturer's instructions

7.1.6 Warranties do not apply where the Product(s) are acquired for rental, hire or other commercial purpose.

7.2 12 Month Warranty

SilverCross provides this Warranty set out in this clause for its prams that have been purchased in Australia.

7.2.4 Customers are liable for any transportation costs if they require replacement or warranty parts to be shipped internationally, even if Product(s) are within the Warranty claim period.

7.2.5 To the extent permitted by law, the following are not covered by Warranty:
(i) failure or defects resulting from improper care or use;
(ii) normal wear and tear including scratches to the pram frame;
(iii) Product(s) purchased second hand or from an unauthorised distributor;
(iv) faulty or incorrect assembly of the Product(s) by the Customer;
(v) installation of a part or accessory not compatible with the Product(s)and/or not manufactured by Silvercross
(vi) tyre punctures;
(vii) any modification or alteration not conducted or authorised by SilverCross
(viii) corrosion or rust on the wheels and chassis due to extreme environmental conditions, including high humidity, salt spray, ice or snow or due to insufficient maintenance;
(ix) accidental or intentional damage, abuse or neglect;
(x) damage to handle bar grips or fabrics as a result of normal handling and daily use;
(xi) airline/transport damage: check your SilverCross Product(s)carefully after it has been handled by the airline (or other transporters) and if required, submit your claim directly to your travel insurer/airline;
(xii) consumer dissatisfaction with the Product(s)in terms of disliking the fit, weight, functionality, colour or style;
(xiii) if the serial number has been damaged or removed; and
(xiv) when the Product(s)has not been used for normal use and in accordance with the manufacturer's instructions

7.2.6 Warranties do not apply where the Product(s) are acquired for rental, hire or other commercial purpose.
